Licensor has created this Software Privacy Statement (the “Privacy Statement”) to explain the types of information we collect through the Software and how we use, disclose and protect this information once it is collected. By downloading, installing, using and/or accessing our Software, you agree to the terms of this Privacy Statement as they may be amended from time to time. Here are a few general principles to keep in mind as you read through this Privacy Statement: The Software is owned by Licensor (referred to collectively in this Privacy Statement as “we,” “us,” “our” and other similar pronouns). This Privacy Statement is incorporated into, and part of, our End User License Agreement, which governs your use of our Software. This Privacy Statement only applies to the Software, and does not apply to any third-party software or website which this Software may compliment or supplement, whether or not intended. As our business evolves and our Software is updated, this Privacy Statement may be updated, so check back periodically to make sure you understand how your End User Information is treated. If you are located outside of the United States, you should know that the information you provide to us is being transmitted to us and processed in the United States and will be protected subject to this Privacy Statement and United States laws, which may not be as protective as the laws in your country. Also, this Software may place cookies and local shared objects on your computer or device which are further described below. By using the Software, you agree to this. What information is collected on this Software? User-Provided Information “End User Information” is information that can be used to identify you as an individual or allow someone to contact you, as well as information attributed with such information. We may collect End User Information such as your name; the name of the company you use the Software on behalf of; company mailing address; company e-mail address; company telephone number; company fax numbers; gender; credit card and other payment information; and demographic information. For example, we may collect End User Information when you conduct a transaction using our Software; create an account using our Software or register for our Software; make purchases through the Software; or upload information to us or otherwise contact us. Health Information We may collect patient information and health or medical information that is processed or accessed by the Software or that you provide to us in connection with our provision of support or otherwise. Software Usage Information Our servers may collect your IP address when you use our Software, and we may associate that with your Internet access provider. We also may collect information about your computer or device and operating system and their settings, the length of your Software session, the time spent within different areas of the Software, the number of times you’ve opened and closed the Software, the number of times the Software has stopped working or “crashed”, customizations you have made to the Software, Software features you have enabled or disabled, other third-party software that accesses or otherwise interacts with the Software, and any plug-ins you've installed. In addition, we may deploy various tracking technologies through the Software to collect additional information about your Software usage. For example: Cookies are small data files stored on your computer or device, placed through the Software. A cookie assigns a unique numerical identifier to your Software, and may enable us to recognize you as the same user who used the Software in the past, and relate your use of the Software to other information about you, such as your Software Usage Information and End User Information. Cookies may also be used to enhance your experience on the Software or to collect general usage and aggregated statistical information and detect and prevent fraud. Local shared objects, such as “Flash cookies,” may be stored on your computer or device using a media player or other software installed on your computer or device. Local shared objects operate a lot like cookies. These tracking technologies may be deployed by us and/or by our affiliates or business partners on our behalf. These technologies enable us to assign a unique number to you, and relate your Software Usage Information to other information about you, including your End User Information. We will give you the option (through the Software settings or otherwise) to reject or delete tracking technologies, but doing so may inhibit or preclude your use of the Software or its features. By using our Software, you consent to our use of these tracking technologies as described above. How is your information used? We or our service providers may use the information we collect from and about you to perform the following business functions: enabling users to use our Software and its features processing and fulfilling your transactions administering the Software and your account with us responding to your requests, questions, and concerns market research developing new features and offerings on the Software protecting our rights and property preventing fraud customizing our Software to your interests and history other purposes disclosed when End User Information is submitted to us Do we share End User Information and Software Usage Information with others? Yes. We may share the information we collect from you or through the Software with others for a variety of reasons. In addition to the kinds of information sharing you might expect, such as sharing with third parties who need your information in order to provide services to us or on our behalf, we may share your information: with Henry Schein Practice Solutions, Inc. and its affiliates for use in accordance with their own privacy policies, including for their marketing purposes when we believe in good faith that disclosure is necessary to protect our rights or property, protect your safety or the safety of others, investigate fraud or respond to a government, judicial or other legal request, or to comply with the law in connection with a corporate change or dissolution, including for example a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets or wind down of business In addition, we may share Software Usage Information (including aggregate data) with others, for their own use, in a form that does not include End User Information or personally identifiable Health Information. Security While we endeavor to protect the security and integrity of sensitive End User Information collected via the Software, we cannot guarantee that any information, during transmission through the Internet or while stored on our system or otherwise in our care, will be absolutely safe from intrusion by others, such as hackers. If you correspond with us by e-mail, you should be aware that your transmission might not be secure. A third party could view the information you send in transit by such means. We will have no liability for disclosure of your information due to errors or unauthorized acts of third parties during or after transmission. If the Software requires you to create an account or register to use the Software, you are responsible for maintaining the strict confidentiality of your account password, and you shall be responsible for any activity that occurs using your account credentials, whether or not you authorized such activity. Please notify us of any unauthorized use of your password or account or any other breach of security. If we believe that the security of your End User Information in our care may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we will endeavor to notify you as promptly as possible under the circumstances. If we have your e-mail address, we may notify you by e-mail. You consent to our use of e-mail as a means of such notification. If you prefer for us to use the U.S. Postal Service to notify you in this situation, please e-mail us. Changes to this Privacy Statement We may change this Privacy Statement from time to time. When we do, we will let you know by making the changed Privacy Statement available to you through the Software or on our website with a new “Last Updated” date. In some cases (for example, if we significantly expand our use or sharing of your End User Information or Health Information), we may also tell you about changes by additional means, such as by sending an e-mail to the e-mail address we have on file for you. In some cases, we may request your consent to the changes.
